There are a few errors in the article: read PATH Maryland as PATH Allegheny (most people can’t keep it all straight) and it is FERC (Federal Energy Regulatory Commission, not PJM who is guaranteeing the 14.3% ROI and the work does not have to be completed. If it does not go forward they get expenses and the 14.3% on what they have spent.
